1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "User," or "you") and Business Boost ("Business Boost," "we," "us," or "our"), operating at businessbst.com and affiliated subdomains.

By creating an account, checking an agreement box, initiating a subscription, or accessing the Business Boost operating system, you agree to be bound by these Terms and our Privacy Policy. If you are accepting these Terms on behalf of a company, partnership, or other legal entity, you represent and warrant that you have full legal authority to bind that entity to these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Services

Business Boost is an all-in-one software-as-a-service (SaaS) small business operating platform. Our Services include, but are not limited to:

• AI CRM & Field Dispatch: Customer relationship management, lead capture, field work scheduling, work orders, automated SMS/email reminders, and route dispatching.
• AI Website Builder & SEO Engine: AI-powered website design and layout generation, managed cloud hosting, custom domain registration/mapping, and programmatic SEO content authoring.
• Autonomous Social Media Engine: Multi-channel AI social media post authoring, asset creation, automated scheduling, performance tracking, and direct API publishing across platforms (Meta/Facebook/Instagram, LinkedIn, X/Twitter, Google Business Profile).
• Billing, Point-of-Sale & Invoicing: Payment processing integrations powered by Stripe Connect, allowing small businesses to issue digital invoices, collect card payments, and manage recurring client retainers.

3. Account Creation & Security

To access the platform, you must register for an account with a valid email address and password. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain and promptly update your account details to keep them accurate.
• Maintain the strict confidentiality of your credentials and restrict unauthorized access to your device.
• Accept sole responsibility for all activities, actions, and transactions executed under your account credentials.
• Notify Business Boost immediately at support@businessbst.com of any suspected unauthorized access or security breach.

4. Generative AI & Customer Content Ownership

Ownership of Customer Data: You retain complete ownership, title, copyright, and intellectual property rights in all data, customer lists, brand assets, logos, and materials you upload to Business Boost ("Customer Content").

Ownership of AI Outputs: Between you and Business Boost, to the fullest extent permitted by applicable law, you own the specific website layouts, copywriting, generated social graphics, and marketing assets generated specifically for your business account by our AI tools.

Nature of AI Generations: Our platform integrates state-of-the-art generative artificial intelligence models (including Google Deepmind / Gemini). While our systems are configured to generate high-quality, industry-relevant outputs, generative AI may occasionally produce outputs that require human refinement. You acknowledge that all AI-generated copy, social posts, and website pages are suggestions, and you maintain ultimate editorial responsibility to review, verify, and approve all content before public distribution.

No Public Model Training on Private Data: Business Boost does not sell your proprietary business data or customer contact lists to third-party data brokers, nor do we use your confidential customer records to train public, generalized third-party foundation models without your explicit consent.

5. Third-Party Social Networks & Integrations

Our platform connects to third-party services including Meta (Facebook & Instagram), LinkedIn, X (Twitter), Google Business Profile, Twilio, and Stripe. When enabling these integrations:

• You expressly authorize Business Boost to interact with those platforms via official APIs on your behalf.
• You agree to comply with the respective third-party terms of service, developer guidelines, and content policies of each connected provider.
• You acknowledge that Business Boost is not responsible for policy enforcement, rate limits, API deprecations, or account suspensions initiated independently by third-party social networks.
• You may revoke authentication tokens or disconnect external accounts at any time through your dashboard settings.

6. Messaging, TCPA & Anti-Spam Compliance

Business Boost equips you with automated messaging and CRM outreach capabilities. You represent, warrant, and agree that:

• You have obtained all legally required prior express written consents from recipients prior to transmitting SMS messages, automated phone calls, or commercial emails.
• Your communications strictly comply with all relevant communications laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), and CTIA guidelines.
• You will never upload bought, rented, or third-party lead scrapings for unsolicited mass messaging.
• You will immediately honor opt-out and unsubscribe commands (e.g., "STOP" for SMS or unsubscribe headers in emails).

7. Subscription Fees, Auto-Renewal & Cancellation

Billing Cycle: Subscriptions are billed in advance on a recurring monthly or annual basis depending on your selected plan.

Automatic Renewal: To avoid service disruption for your live websites and CRM automations, your subscription automatically renews at the end of each billing cycle unless cancelled prior to the renewal date. You authorize us to charge your registered payment method on file via Stripe.

Self-Service Cancellation: You can cancel your subscription at any time with zero hassle directly through your Billing Dashboard (account.businessbst.com/billing). Upon cancellation, your access remains fully active until the end of your current paid billing period, with no subsequent charges.

Refunds: Unless explicitly stated otherwise during promotional offers or required by applicable consumer law, subscription charges are non-refundable for partial service periods.

8. Acceptable Use & Prohibited Conduct

You agree to use Business Boost solely for lawful business operations. You shall not:

• Publish defamatory, fraudulent, deceptive, infringing, or illegal material.
• Introduce malware, viruses, worms, or malicious code into the platform or hosted customer websites.
• Reverse-engineer, decompile, or attempt to extract the source code or proprietary architecture of the Service.
• Use automated bots or scripts to scrape data from Business Boost systems.
• Interfere with or disrupt the integrity, security, or performance of our cloud infrastructure.

9. Warranty Disclaimers

Notice Regarding Warranties:

EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE SERVICE AND ALL ASSOCIATED HOSTED WEBSITES AND AI CAPABILITIES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUSINESS BOOST DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FULLY IMMUNE TO NETWORK DISRUPTIONS.

10. Limitation of Liability

Notice Regarding Liability:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BUSINESS BOOST, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

BUSINESS BOOST'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO BUSINESS BOOST IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Business Boost and its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your Customer Content; (b) your violation of these Terms; or (c) your violation of any applicable law, including communications and privacy regulations.

12. Data Privacy & GDPR / CCPA Compliance

Our collection and processing of your personal information is governed by our comprehensive Privacy Policy. We adhere to strict data privacy principles under the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

Marketing opt-in consent is strictly voluntary, unbundled from terms acceptance, and can be withdrawn at any time without affecting your account access or operational service communications.

13. Modifications to Terms

We reserve the right to modify or replace these Terms at our discretion. If a revision is material, we will provide at least 30 days' advance notice prior to any new terms taking effect via an email notification or prominent announcement in your dashboard. Continued use of the platform following the effective date of revisions constitutes full acceptance of the updated Terms.
